2. Acceptance of Terms

By accessing our website or placing an order, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Cookie Policy and Returns Policy, which form part of this agreement.

If you do not agree, you must not use the website or place an order.

3. Eligibility and Website Use

You must be at least 18 years old to place an order.

You agree not to:

  • Interfere with the website’s security or operation

We reserve the right to suspend or terminate access for breaches.

5. Prices, VAT and Payment

  • UK orders are subject to VAT where applicable

All payments must be made in full before dispatch.

For deliveries outside the UK:

  • Goods are supplied on a Delivered At Place (DAP) basis unless otherwise agreed
  • You are responsible for all import charges and customs clearance
  • Failure to pay customs charges may result in return or destruction without refund

We are not responsible for customs delays.

7. Order Acceptance and Cancellation

Order confirmation emails do not constitute acceptance. Acceptance occurs upon dispatch.

We reserve the right to refuse or cancel orders, including for pricing or listing errors. Refunds will be issued where applicable.

8. Delivery

Delivery times are estimates only and not guaranteed.

Risk passes to you upon delivery.

We are not liable for delays caused by couriers, customs authorities or events beyond our control.

9. Consumer Right to Cancel (UK and EU Consumers)

If you are a consumer, you may cancel your order within 14 days of delivery, in line with the Consumer Contracts Regulations.

Exceptions apply to:

  • Custom or personalised items
  • Sealed goods opened after delivery
  • Items marked as non-returnable

Return postage costs are your responsibility unless the goods are faulty.

10. Faulty Goods and Statutory Rights

Nothing in these Terms limits your rights under the Consumer Rights Act 2015.

Faulty goods may be eligible for repair, replacement or refund.

Trade customers’ remedies are limited to repair or replacement.

11. Trade and Business Customers

If purchasing in the course of business:

  • You confirm you are not acting as a consumer
  • Consumer protections do not apply
  • Liability is limited to the value of the goods supplied

12. Retention of Title

Ownership of goods remains with Armitage Tools until payment is received in full, including any interest or charges.

13. Intellectual Property

All website content is owned by or licensed to Armitage Tools and protected by intellectual property laws.

14. User Submissions

Any feedback or submissions may be used by us without restriction. You confirm you have the right to submit such content.

We aim to acknowledge complaints within 2 business days and resolve them within 14 days where possible.

18. Alternative Dispute Resolution (ADR)

We do not currently participate in ADR schemes.

19. Limitation of Liability

We do not exclude liability for death or personal injury caused by negligence, fraud or matters that cannot be excluded by law.

Subject to this, liability is limited to the value of the goods purchased.

20. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including supply chain disruption, customs delays, strikes or acts of government.

21. Termination

We may suspend or terminate access for breach of these Terms. Accrued rights remain unaffected.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. UK courts have exclusive jurisdiction.

23. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.
